DISTANCE SALES AGREEMENT

ARTICLE 1 – PARTIES

1.2. BUYER

The buyer is the consumer who places an order through the website and is identified by their name, surname, delivery address, and contact information provided during the order and payment stages.

The buyer's order information is included in the order summary and order records.

ARTICLE 2 – SUBJECT OF THE AGREEMENT

The subject of this agreement is the sale and delivery of the products ordered by the Buyer electronically through the website https://mapfarma.net/, and the determination of the rights and obligations of the parties within the scope of the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.

ARTICLE 3 – SUBJECT OF THE AGREEMENT AND ORDER INFORMATION

The name, type, quantity, basic characteristics, selling price, and other order information of the product(s) are specified in the order summary and order record.

Product(s): As specified in the order summary.

Quantity: As stated in the order summary.

Total cost of products: As stated in the order summary.

Shipping and delivery costs: Will be specified during the order process.

Total payment including taxes: This is the total amount shown during the order process.

Payment method: This is the payment method chosen by the buyer.

The buyer can see the total amount due and any additional charges before confirming their order.

ARTICLE 4 – ESTABLISHMENT OF THE AGREEMENT

Before placing an order, the buyer reviews the product information, total price, delivery terms, and information regarding the right of withdrawal.

By confirming the order, the Buyer acknowledges that they become obligated to pay the total amount of the order.

Electronic records relating to the conclusion of the contract are stored in accordance with applicable legislation.

ARTICLE 5 – PAYMENT

The buyer pays for the order using one of the payment methods offered on the website.

Payment transactions are carried out in accordance with the terms and conditions of the payment infrastructure used. Order preparation and shipping depend on payment confirmation and order status.

The seller will inform the buyer if any situation arises that affects the fulfillment of the order and will fulfill its legal obligations.

ARTICLE 6 – DELIVERY AND PERFORMANCE

The product will be shipped to the delivery address provided by the Buyer during the order process.

Teslimat, sipariş sırasında belirtilen süre içerisinde gerçekleştirilir. Her hâlükârda mevzuatta öngörülen azami teslim süresi gözetilir.

Satıcı, ürünün tüketiciye teslim edilene kadar oluşan kayıp ve hasarlardan mevzuat çerçevesinde sorumludur.

Alıcı'nın teslimat adresini yanlış bildirmesi veya teslimatı engelleyen başka bir durum ortaya çıkması hâlinde, durum taraflarca ilgili mevzuat çerçevesinde değerlendirilir.

MADDE 7 – CAYMA HAKKI

Alıcı, mesafeli satış kapsamında, mevzuatta öngörülen istisnalar saklı kalmak üzere, ürünün kendisine teslim edildiği tarihten itibaren 14 gün içerisinde herhangi bir gerekçe göstermeksizin ve cezai şart ödemeksizin cayma hakkını kullanabilir.

Ürün teslim edilmeden önce de cayma hakkı kullanılabilir.

Cayma hakkının kullanılabilmesi için cayma bildiriminin yasal süre içerisinde Satıcı'ya yazılı olarak veya kalıcı veri saklayıcısı aracılığıyla iletilmesi gerekir.

Cayma hakkı bildiriminin yapılması için Alıcı'nın gerekçe göstermesi zorunlu değildir.

MADDE 8 – CAYMA HAKKININ İSTİSNALARI VE KOZMETİK ÜRÜNLER

Cayma hakkı, Mesafeli Sözleşmeler Yönetmeliği'nde belirtilen istisnalar kapsamında kullanılamayabilir.

Özellikle, tesliminden sonra ambalaj, bant, mühür veya paket gibi koruyucu unsurları açılmış olan ve sağlık ve hijyen açısından iadesi uygun olmayan ürünlerde mevzuattaki cayma hakkı istisnası uygulanabilir.

Bu istisna, her kozmetik ürünün koşulsuz olarak iade edilemeyeceği anlamına gelmez. Ürünün niteliği, koruyucu ambalajının durumu ve ilgili mevzuat hükümleri somut olayda dikkate alınır.

Ayıplı, hasarlı, yanlış gönderilmiş veya sözleşmeye uygun olmayan ürünlere ilişkin tüketici hakları saklıdır.

MADDE 9 – CAYMA HAKKININ KULLANILMASI VE İADE

Cayma hakkının usulüne uygun kullanılması hâlinde Alıcı, cayma bildirimini gönderdiği tarihten itibaren mevzuatta öngörülen süre içerisinde ürünü geri göndermelidir.

İade gönderiminde uygulanacak kargo ve masraf koşulları, sipariş öncesinde Alıcı'ya bildirilen bilgiler ve yürürlükteki mevzuat doğrultusunda belirlenir.

Satıcı, cayma hakkının kullanılması hâlinde tahsil edilen ödemeleri, teslimat masrafları dâhil olmak üzere mevzuatta öngörülen süre ve yöntemle iade eder.

İade, ilgili mevzuata uygun olarak ve varsa satın alma sırasında kullanılan ödeme aracına ilişkin kurallar gözetilerek gerçekleştirilir.

Ayıplı veya sözleşmeye aykırı ürünler bakımından Alıcı'nın kanundan doğan hakları saklıdır.

MADDE 10 – AYIPLI VEYA HATALI ÜRÜNLER

Teslim edilen ürünün ayıplı, hasarlı, yanlış veya siparişe aykırı olması durumunda Alıcı, Satıcı ile iletişime geçerek durumu bildirebilir.

The buyer reserves the right to exercise their optional rights under Law No. 6502 and related legislation. These rights may include, depending on the conditions, free repair of the product, replacement with a faultless equivalent, a price reduction, or termination of the contract.

The rights specified in this article shall be assessed within the framework of applicable legislation, taking into account the nature of the product and the circumstances of the case.

ARTICLE 11 – FORCE MAJEURE

Events beyond the control of the parties that prevent the fulfillment of contractual obligations will be evaluated within the framework of relevant legislation.

If the fulfillment of the order becomes impossible due to force majeure, the Seller will inform the Buyer and fulfill its obligations under the legislation.

ARTICLE 12 – PERSONAL DATA

Personal data shared by the buyer during the order and delivery process is processed in accordance with relevant legislation.

Detailed information regarding the processing of personal data can be found in the "Clarification Text on the Protection and Processing of Personal Data" published on the website.

ARTICLE 13 – RESOLUTION OF DISPUTES

In case of any disputes arising from this agreement, recourse may be made to the competent and authorized consumer arbitration boards and consumer courts within the scope of the applicable legislation.

In applications to the consumer arbitration board, the monetary limits valid on the date of application shall apply. The provisions of the legislation regarding mandatory mediation before filing a lawsuit in the consumer court are reserved.

ARTICLE 14 – ENTRY INTO FORCE

The buyer has the opportunity to review the contract and preliminary information regarding their order before completing the order.

This agreement is established within the framework of applicable legislation upon electronic confirmation of the order.
